TERMS AND CONDITIONS AS SET OUT BELOW.
Participant Agreement
In consideration of my participation in the National Science Teachers Association (“NSTA”) Innovation Marketplace
program (“Program”), I hereby agree to the following:

I grant permission to NSTA to use, reproduce, and distribute the information that I provide under the Program, including distributing the information for use by third party testing companies participating in the Program.

I will comply with the terms, conditions and procedures of the Program established by NSTA and any terms, conditions procedures established by the company whose products/materials I may be evaluating or testing. I understand that NSTA may change the terms, conditions and procedures of the Program at any time and that such changes shall be effective when communicated to me. I also understand that NSTA may amend, modify or terminate the Program at any time.

I agree that product/material testing and evaluation shall be completed on my own time, not during scheduled business and/or school hours. I agree that product/material testing and evaluation shall be completed by me only and that no student may take part.

I understand that testing companies may or may not provide compensation for evaluating and testing their products; that payment of such compensation, if any, is solely the responsibility of the testing company; and that NSTA shall under no circumstances have any responsibility or liability to collect or pay any compensation to any participant or reimburse any participant expenses whatsoever.

I agree to indemnify and hold harmless NSTA, and its officers, directors, employees, members and representatives, from any and all claims, demands, suits, actions, judgments, liabilities, losses, damages, costs and expenses, including reasonable attorney’s fees (collectively, “claims”), arising out of or relating to my participation under the Program, including, but not limited to, any claims relating to products/materials provided for testing and evaluation by third parties.

All Program participants shall be and at all times remain independent contractors, and this Agreement shall not create or be deemed to create, constitute recognize or imply any joint venture, partnership, employer/employee or principal/agent relationship between NSTA and any participant including any testing company.
